ALBANY, Ga. (WALB) - A counterclaim has been filed by Dougherty County commissioners in response to the lawsuit filed by former county administrator, Mike McCoy. It states they deny allegations made by McCoy and that they have sovereign immunity that protects them.

In McCoy’s lawsuit, he accuses County Chairman Lorenzo Heard and Commissioner Gloria Gaines, Clinton Johnson, and Victor Edwards of committing several illegal actions leading up to and following his firing. They include unlawful discrimination, retaliation, and engaging in conduct as a whistleblower.

He is asking for at least $5 million and to be reinstated as county commissioner, along with other financial damages.

In the counterclaim that county commissioners filed on March 8, commissioners are asking the court to dismiss McCoy’s complaint with prejudice saying “McCoy’s intentions in these filings has been malicious and stubbornly litigious.”

They are also asking for McCoy’s 2023 employment agreement to be declared null and void and for reimbursement in their five attorney’s fees, as well as other unspecified financial relief. Maurice King, McCoy’s attorney, said in this case, county leaders are not barred by sovereign immunity.

“They don’t really have any claim. What they are saying is that because Mr. McCoy sued them, he’s abusing the legal process but under our law, if you have grievances and you want to address those grievances, you basically file a lawsuit against those that have wronged you,” he said.

Dougherty County Attorney Alex Shalishali declined to comment at this time but said “The responsive pleadings filed by the defendants in the lawsuit filed by Mr. McCoy are matters of public record that speak for themselves.”

“They may have won a battle when they terminated Mr. McCoy but we intend to win the war,” he said. “I think they filed a counterclaim that has no basis, merit and factor in law and I think they filed it in order to curry favor with the four commissioners that we sue.”

King said in the next couple of months or so he will send a written discovery to the four commissioners which will ask them to answer questions under oath about the firing of McCoy. He also says there is a possibility he will take a disposition from the county attorney.
