ALBANY, Ga. (WALB) - An Albany attorney accused of multiple ethics violations has offered to temporarily suspend his law license while disciplinary proceedings play out against him. The petition still has to be approved by the Georgia Supreme Court.
The State Bar of Georgia filed a petition on Sept. 11 asking that Durham’s license be temporarily suspended because he was “actively receiving settlement money belonging to his clients and using that money to pay for his own obligations and those of other clients,” and “converting and misusing funds recovered on behalf of clients.”

Durham’s counsel expects that the Supreme Court will approve his “voluntary interim suspension,” but they said they are not sure when. Contrary to some social media speculation, Durham has not surrendered his law license. Durham’s counsel said he intends to return to the practice of law at some point in the future, unless the Supreme Court issues a disbarment at the end of these legal proceedings.
In the voluntary interim suspension filing, Durham’s counsel admitted that “the State Bar has alleged a sufficient factual basis for a finding that he poses a substantial threat of harm to his clients or the public based on the way that he has managed funds entrusted to him.”
If the suspension is granted by the Georgia Supreme Court, Durham acknowledges that he:
- Will not take on any new clients or accept any retainers for future legal services to be rendered
- Will promptly notify all clients that he has submitted this petition
- Will cease the practice of law until the final disposition of his disciplinary proceedings
Durham’s counsel said he made the filing in “an attempt to fully cooperate with the State Bar’s investigation of him.”
He also agreed to “cooperate with the State Bar to complete a full forensic audit of his relevant bank accounts.”
The special master in this case, also known as the person appointed to make a recommendation to the Georgia Supreme Court, will eventually make another recommendation regarding what, if any, final disciplinary action should be taken against Durham regarding the pending violations against him.
Durham’s legal counsel issued a statement that said Durham “is committed to ensuring a smooth transition for his current clients so that their rights are protected. By stepping away from active practice, Mr. Durham can appropriately address these allegations and ensure this process is based on the facts and not fiction.”
