WASHINGTON (TNND) — Critics say a November 2022 traffic stop by the Tennessee Highway Patrol for speeding should have landed Kilmar Abrego Garcia in jail, followed by a deportation.

The video shows the officer asking Abrego Garcia about how many rows of seats he has in the car he's driving and asking for his driver's license, which Abrego Garcia said is expired.

Another officer at the scene suggests that with eight people in the car, Abrego Garcia is likely "hauling these people for money."

Instead of being arrested, Abrego Garcia was only given a warning by the Tennessee Highway Patrol for driving with an expired license.

The video shows the conversation, and the police dog sniffing the vehicle for drugs, which are not found.

Abrego Garcia has become well-known recently for being deported by the Trump Administration to a supermax prison in El Salvador.

While Justice Department lawyers admitted the deportation was made in error, top officials now say the facts of the case have changed.

I don't accept the term 'error' in Abrego Garcia," Homan said. "There was an oversight, there was a withholding order. But the facts surrounding the withholding order had changed. He is now a terrorist, and the gang he was fearing, from being removed from El Salvador, no longer exists."

Homan is referring to the Foreign Terrorist Designation President Trump gave to the MS-13 gang, of which he insists Abrego Garcia was a part.

For weeks, Abrego Garcia’s wife, Jennifer Vasquez Sura, has been pleading for his release, including during a rally in Washington, D.C. this week.

My husband was illegally detained, abducted, and disappeared. Thrown away to die in one of the most dangerous prisons in El Salvador with no due process because of an error," she said during a speech Thursday.

But over the last few weeks, we have learned she also filed multiple protective orders against him for domestic abuse, with audio from one of her court appearances obtained by USA Today.

She can be heard saying, "I have pictures of the evidence, like all of the bruises, because even on Wednesday, he hit me around like 3 in the morning. He would just wake up and like hit me. And then last Saturday, for my daughter’s birthday party, before I went to my daughter’s birthday party, he slapped me three times.”

In a statement, Vasquez Sura acknowledged the previous struggles but insists things have changed.

"My husband was traumatized from the time he spent in ICE detention and we were in the throes of COVID. Like many couples, we were caring for our children with barely enough to get by. All of those factors contributed to the actions which caused me to seek the protective order."

His case has sparked protests from people calling for his release and has mobilized Democrats, including Maryland Sen. Chris Van Hollen, who met with Abrego Garcia in El Salvador.

At the rally on Thursday, Sen. Van Hollen also spoke about the case.

"The right to do process is a bedrock American principle and in his first 100 days, Donald Trump is shredding the Constitution of the United States. He's violated these rights in many instances, including the illegal abduction and deportation of Kilmar Abrego Garcia," Van Hollen said.
