ALBANY, Ga. (WALB) — A husband who allegedly shot his wife in the face was indicted by a grand jury in Dougherty County.

As of Oct. 2, John Todd Fleming’s charges were upgraded. He now faces:

  • Criminal attempt to commit a felony
  • Aggravated assault-family violence
  • Aggravated battery-family violence
  • Possession of a firearm during the commission of a felony
  • Tampering with evidence
  • Possession of a firearm by a convicted felon

Originally, WALB reported that Fleming faced four of the 6 charges.

According to the indictment Fleming, “... did knowingly and intentionally attempt to commit the crime of Murder... when said accused did grab a loaded handgun and shot (the victim) in the face.”

It also said he “... did maliciously cause bodily harm to (the victim) by depriving said person of an eye.”

For count five, the state said Fleming “... did knowingly conceal physical evidence, to wit: a Taurus .38 Revolver handgun, said evidence involving the prosecution.”

WALB previously reported that Fleming was arrested and charged with shooting his wife during a domestic argument on Monday, April 6.

Fleming was set to appear Oct. 2 for arraignment; however, his attorney waived arraignment.

In April, a judge denied bond for Fleming. In July, he received a $75,000 bond.

According to his bond conditions, Fleming is not allowed to have any contact with the victim, and he must stay away from their residence where the incident happened.

District Attorney Greg Edwards said the next step is for the case to go to trial.
