WASHINGTON (TNND) — The personal data of 79 million Medicaid recipients will be handed over to Immigration and Customs Enforcement (ICE) to track down immigrants who may not be living legally in the United States.

Home addresses, ethnicities and social security numbers will be provided, according to an agreement obtained by The Associated Press between the Centers for Medicare and Medicaid Services (CMS) and the Department of Homeland Security (DHS).

The agreement, which has not been publicly announced, will give ICE agents the ability to find "the location of aliens."

“ICE will use the CMS data to allow ICE to receive identity and location information on aliens identified by ICE,” the agreement states.

The new move follows a similar demand from the Trump administration last month, requesting personal Medicaid data from seven Democratic-led states that allow non-U.S. citizens to enroll.

As a result, 20 states recently sued the Trump administration for illegally sharing personal health data, arguing that the "mass transfer" of this data violates the law. Multiple attorneys general asked the court to bar any new transfers or use of the data for immigration enforcement purposes.

HHS spokesman Andrew Nixon would not respond to the latest agreement, according to The Associated Press. It is unclear, though, whether Homeland Security has yet accessed the information. The department’s assistant secretary, Tricia McLaughlin, said in an emailed statement that the two agencies “are exploring an initiative to ensure that illegal aliens are not receiving Medicaid benefits that are meant for law-abiding Americans.”

The agreement does not allow ICE officials to download the data. Instead, they will be allowed to access it for a limited period from 9 a.m. to 5 p.m., Monday through Friday, until Sept. 9.

Immigrants who are not living in the U.S. legally, as well as some lawfully present immigrants, are not allowed to enroll in the Medicaid programthat provides nearly free coverage for health services.

The only healthcare that might be “covered” for them is emergency care – emergency room visits, emergency dialysis, childbirth and any life-saving care – but it’s less for the benefit of the migrant as it is to help hospitals recoup the cost of treating them.
