NEW YORK (TNND) — Sean "Diddy" Combs' lawyers on Thursday asked the judge overseeing his case to acquit him or give him a new trial.
Combs' defense argued in a 62-page memorandum that he was unfairly targeted by the federal government and his conviction was "unconstitutional" and unprecedented, according to records reviewed by The New York Times.
The music mogul was found guilty on two counts of transportation to engage in prostitution earlier this month, but was acquitted of racketeering conspiracy and sex trafficking, which would have put him in prison for life.
Lawyers stated in the filing that Combs' conviction under the Mann Act, known as the White-Slave Traffic Act, which makes it illegal to transport people across state or international lines for the purpose of prostitution, should be overturned.
“To our knowledge, Mr. Combs is the only person ever convicted of violating the statute for conduct anything like this,” the filing states.
His lawyers have continuously argued throughout the case that the sexual encounters referred to as "freak offs" or "hotel nights" were consensual and that Combs had no financial motive.
“Mr. Combs, at most, paid to engage in voyeurism as part of a ‘swingers’ lifestyle,” Alexandra Shapiro, an appellate lawyer who is part of the Combs defense team, said. “That does not constitute ‘prostitution’ under a properly limited definition of the statutory term.”
In another motion on Tuesday, lawyers asked the judge to release Combs on a $50 million bond while he awaits sentencing in October.
The court filing obtained by The Associated Press states Combs' lawyer argued that the Metropolitan Detention Center in Brooklyn is dangerous, adding that others convicted of similar prostitution-related offenses were usually released before sentencing.
“Sean Combs should not be in jail for this conduct,” Marc Agnifilo said. “In fact, he may be the only person currently in a United States jail for being any sort of john, and certainly the only person in jail for hiring adult male escorts for him and his girlfriend.”
