WASHINGTON (TNND) — 45-year-old Mohamed Sabry Soliman has now been charged with a hate crime for the attack on a Jewish community event in Boulder, Colorado, on Sunday. It was a crime that top officials say the suspect should never have been able to commit.

Now booked in a Colorado jail, the Department of Homeland Security's Assistant Secretary Tricia McLaughlin said:

"The suspect, Mohamed Soliman, is illegally in our country. He entered the country in August 2022 on a B2 visa that expired in February 2023. He filed for asylum in September 2022."

In an interview with Fox News on Monday, Rep. Kat Cammack, R-Fla. said, "This man was in the country illegally. Had overstayed a visa. It was pretty telling. It should have been a red flag when he filed for asylum one month after receiving his temporary visa. But again, he overstayed his visa when it expired.”

In a post on Truth Social Monday, President Donald Trump said that the suspect "came in through Biden’s ridiculous open border policy, which has hurt our country so badly. He must go out under “TRUMP” policy.

That "Trump policy" includes a recent crackdown by the Department of Justice on migrants who have not yet registered with the federal government online, a mandate stemming from a law passed in 1940 used in large part to target Japanese Americans.

The requirement was incorporated into an Executive Order signed by President Trump on his first day in office, which he titled "PROTECTING THE AMERICAN PEOPLE AGAINST INVASION."

The form is available online, and the deadline for registration passed in April.

"All aliens 14 years of age or older who were not registered and fingerprinted (if required) when applying for a U.S. visa and who remain in the United States for 30 days or longer."

That Executive Order requires illegal immigrants 14 years and older to register with the federal government, providing fingerprints and a home address.

Those who fail to sign up could be charged with a misdemeanor and face $5,000 in fines and up to six months in prison.

Immigrant advocates have slammed the policy.

In an interview with Sinclair Monday, Immigration Attorney Allen Orr said, "This is largely shooting fish in a barrel for the Trump administration."

He said, "They’re asking people to register and they're removing the people who are registering. Once again, it is law-abiding immigrants who have challenges with their documentation who are in the system, who are going to follow the law and for following the law, those individuals are gonna be removed."

Orr argued that the registry requirement sends the same message as recent arrests at courthouses for immigrants showing up for their immigration hearings.

That message? Following the rules could get you deported.
