ALBANY, Ga. (WALB) - Albany Police (APD) is investigating after a man allegedly engaged in sexual relations without disclosing his HIV-positive status.
According to the police report, a woman contacted police to report that her off-and-on boyfriend of three years was HIV positive and did not tell her. Police identified him as Byron Bivens, 37.
She reportedly found out about his HIV status after seeing that Bivens had medication labeled Biktarvy, a medication used to prevent the spread of HIV from an HIV infected person.
She then went to the Health Department for testing and tested negative for HIV.
She later confronted Bivens, and he confirmed he was HIV positive.
Bivens told her that he had been HIV positive before they were together. He learned he was positive from giving plasma.
She told police that she recorded a video of him confirming that he was HIV positive.
When officers saw the video, it showed her saying she just found out that he was positive, then turning the camera to Bivens, who confirmed that he did not disclose his HIV status.
APD says an investigation has been launched.
